Terms of use
These Terms and Conditions (hereinafter referred to as the “Terms”) set out the general terms of business between the company with ID No. 07638990, hereinafter referred to as “Cyberometer”, and the Client (entrepreneur). The Terms are governed by Act No. 89/2012 Coll., the Civil Code, as amended, and regulate the use of services provided by Cyberometer.
1. SERVICES AND THEIR USE
Cyberometer:

provides cybersecurity consulting services,

operates the website www.cyberometer.com.
Website Cyberometer owns all rights, particularly copyright and related rights, to the content of its website, including text, design, graphics, trademarks, logos, generated reports and recommendations, as well as the selection and arrangement of files. Some content may also be protected by third-party rights.
All visitors and users of the website (hereinafter referred to as "Users") are subject to these Terms of Website Use ("Rules"). By accessing any part of the Website, the User agrees to these Rules.
All information on the website is non-binding and provided for informational purposes only. Cyberometer may change or remove any content at any time. The publication of content, with the exception of these Rules and the Privacy Policy, does not constitute any legal act leading to a legal relationship between the Operator and the User.
Cyberometer Platform By using the Cyberometer platform, you are granted a non-exclusive, non-transferable license to use the platform for contractual purposes only. You may not modify, copy, distribute, or share the software without Cyberometer’s express consent.
All software rights, including copyrights, remain the exclusive property of Cyberometer. You agree not to violate these rights.
The platform is intended exclusively for use by businesses and public authorities for professional or administrative purposes. You agree to use the platform solely in this capacity.
Data can be submitted to the platform via:

online forms,

file uploads,
-
API integration.
The Cyberometer platform operates on Microsoft Azure cloud infrastructure located in the EU (Frankfurt), with data stored in Western Europe (Google Cloud in the Netherlands and Belgium). Data is encrypted in transit and at rest using industry-standard methods.
Key technologies include:

Microsoft SQL Server on Azure,

Google Firebase Functions and Azure Flows,

React.js frontend with React Router and environment configuration for development, staging, and production environments.
2. USER ACCOUNT
Access to the Cyberometer platform is via a master user account, created through an online registration form. You agree to provide accurate, complete, and current information and to keep it up to date.
If you accept these Terms on behalf of an entity (e.g., employer), you confirm that you have the legal authority to bind that entity.
User accounts are role-based (Owner, Manager, Responder, Viewer). The Owner can manage user access within the organization.
You are responsible for securing your login credentials. You must:

secure devices used to access the platform,
-
use strong passwords,
-
prevent unauthorized access,
-
notify Cyberometer of any breach or misuse immediately.
Cyberometer, its contractors, or employees may access your account for support, maintenance, billing, or security purposes.
Accounts are valid for an indefinite period unless terminated under these Terms.
3. PRICE AND PAYMENT TERMS
Website content is publicly available and free of charge.
Use of the Cyberometer platform is subject to a fee, based on selected modules and company size. A free trial is available. Prior to its expiry, Cyberometer will contact you with a pricing offer.
You may pay monthly or annually, by credit/debit card via the integrated gateway ("Subscription") or by invoice. Fees are payable in advance.
You agree to:

provide accurate billing information,

maintain updated payment details,
-
authorize recurring payments if subscribed.
If a recurring payment fails or an invoice is overdue, Cyberometer will notify you. You have 7 days to provide updated payment information, or your account may be suspended or cancelled.
Cyberometer reserves the right to change pricing with at least 15 days’ notice. New pricing does not affect already paid periods. If you do not agree, your subscription will end at the close of the current period.
Subscriptions renew automatically unless cancelled by either party before the end of the current paid term via email at info@cyberometer.com.
Prices exclude VAT unless otherwise stated.
No refunds are provided unless otherwise agreed or required by law.
4. USE OF SERVICE AND SUPPORT
The Service is provided exclusively online. You are responsible for ensuring your internet connection and device settings allow full use.
Cyberometer may improve, modify, or discontinue features at any time. If changes affect access to your content, you will be notified in advance.
Cyberometer aims to maintain 99.9% uptime (SLA). Temporary unavailability may occur due to:

maintenance,
-
technical issues,
-
third-party failures,
-
connectivity issues,
-
force majeure.
Service level discounts:
-
99.5–99.89%: 10% discount,
-
99.0–99.49%: 20% discount,
-
95.0–98.9%: 50% discount,
-
<95.0%: 70% discount.
You may not:
-
commercially exploit, reproduce, modify, sublicense, sell, or distribute the Service;
-
publicly display or reverse-engineer the software;
-
tamper with security;
-
use the Service unlawfully;
-
remove any branding.

5. YOUR CONTENT AND DATA PRIVACY
To deliver the Services, Cyberometer processes personal data of users and employees. Details are available in our Privacy Policy.
You remain the owner of any content you upload. Cyberometer is not responsible for its accuracy or legality.
Cyberometer may review content suspected of violating these Terms or the law and may block or remove it, or suspend/terminate your account.
We may use each other’s name and logo for identification in marketing materials.
6. CONFIDENTIALITY
“Confidential Information” means any non-public technical, commercial, or operational information, including source code, algorithms, designs, trade secrets, and dummy data used for demonstration purposes.
You may not share such information unless explicitly authorized or required by law.
The duty of confidentiality lasts throughout your account's validity and for 5 years thereafter.
We may share your contact details with trusted third parties if you express interest in their services.
7. THIRD-PARTY LINKS AND SERVICES
The Service may include links to third-party sites or services. We are not responsible for their content or terms of use. You will be asked for consent before any required data is shared with them.
8. TERM AND TERMINATION
You may terminate your Cyberometer master account at any time by contacting info@cyberometer.com.
You may suspend the account for 30 or 60 days. After that, it will be permanently deleted.
Upon termination:

all access rights are revoked,
-
your data will be deleted unless required to be retained by law,

Cyberometer is not responsible for backing up your data.
Cyberometer may terminate the agreement with 2 months’ written notice or immediately in the event of:

violation of Terms or laws,
-
connection to criminal activity,
-
detection of malware,
-
insolvency or liquidation.
9. WARRANTIES AND LIMITATION OF LIABILITY
Cyberometer provides services with due care and expertise. Nothing in these Terms limits liability for breach of this duty.
Cyberometer is not liable for indirect damages (e.g., loss of profit), except in cases of gross negligence or intent.
Free tools or calculators are non-binding and not auditable.
The Service is general-purpose and not suited for critical environments (e.g., life support, safety-critical operations).
Cyberometer is not liable for failures caused by force majeure.
By submitting feedback (e.g., on product ideas), you grant Cyberometer the right to use it freely without obligation.
You agree to:

not use the platform for illegal or harmful content or behavior,
-
not impersonate others,
-
not manipulate ratings or access,
-
indemnify Cyberometer against legal claims from your misuse of the Service.
Both parties will comply with anti-bribery and anti-money laundering regulations.
10. FINAL PROVISIONS
These Terms are governed by Czech law.
Cyberometer may update the Terms due to:
-
legal requirements,
-
service development,
-
operational needs.
You will be notified at least 7 days in advance via email or platform message.
Continued use implies acceptance. If you disagree, cancel your account. Cyberometer may terminate the contract within 60 days of your objection.
Any disputes will be resolved amicably or by Czech courts.
If any part of these Terms is deemed invalid, the rest remains in force.
Communication will be in Czech or English. Electronic communication is considered sufficient in writing.
Terms that survive termination (e.g., confidentiality, data protection) remain valid after the Service ends.
In the event of discrepancies between language versions, the Czech version prevails.
